New Massachusetts Health Care Reform Act: Covered Employers Must Comply by July 1

The new Massachusetts Health Care Reform Act's July 1 deadline is quickly approaching. In a nutshell, the Act requires employers with 11 or more full time employees to provide health insurance, make minimum contributions toward the premium, and establish a section 125 plan to allow employees to pay health insurance premiums on a pre-tax basis. On the individual side, all residents of Massachusetts are required to have health insurance or face the loss of their personal exemption for income tax purposes in 2007; penalties will increase in later years. Multi-state employers, such as NH based companies, that have locations and/or employees in Massachusetts, are especially susceptible to being caught in a compliance problem. Employers that do not comply will be required to make a contribution ($295 per employee) to the state's free care pool and may also be subject to penalties if their employees access the free care pool for healthcare. Questions regarding this new law may be directed to the attorneys in Sheehan Phinney's Health Care Reform Act Team,
