Workplace Identity Theft: Proactive Measures Employers Can And Should Take To Combat It

Identity theft is one the fastest growing crimes in the Unites States. A prime target for identity theft is employee sensitive identifying information (EII) maintained by employers. Indeed, according to the Federal Trade Commission (FTC), about 90 percent of business-record thefts involves payroll or employment records. This article provides some suggested steps to be taken by employers to reduce the chances of workplace identity theft and to minimize possible liability. EII management policies and procedures should be customized, however, with the assistance of the company’s legal counsel, to meet the unique needs and the legal requirements of the employers’ specific industry and activities, at both the federal and state level. Deferred Compensation Plans Affected By New Legislation

Recent legislation contains comprehensive changes to the federal tax laws governing nonqualified deferred compensation plans. The IRS has issued guidance that appears to provide a generous one-year grace period for brining existing plans into compliance. Don’t be deceived. Certain elections will have to be made by March 15, 2005 and regardless of when a plan is amended during the year, it must be operated in compliance with the new rules throughout the year. Amending a plan early in the year will provide a simple way for taxpayers to learn how to operate the plan in accordance with the new rules. [Contact Author]

Real Estate Transfer Tax Issues Bedevil Investors

New Automatic Rollover Requirements For Plan Sponsors by Alan P. Cleveland

Effective March 28, 2005, qualified pension and profit-sharing plans need to be amended to provide for automatic eligible rollovers of so-called "mandatory distributions", that is, involuntary distributions to terminated participants in amounts of less than $5000. The new automatic rollover |

requirement applies to mandatory distributions of amounts greater than $1000 to participants not yet of retirement age. If a distributee does not elect to either receive the distribution directly or have it rolled over to an eligible retirement plan of his or her choosing, then the distribution must be automatically rolled over to an IRA maintained by a financial institution selected by the plan administrator. Plan amendments providing for the required automatic rollovers must be adopted effective March 28th. In the meantime, a plan may suspend the processing of all mandatory distributions until December 31, 2005 to allow it time to make the necessary arrangements for administering such automatic IRA rollovers. Another Jewel In Queen City’s Crown: Fisher Cats’ New Stadium to Open April 7th, Sneak Preview this Thursday, February 17th! | The 2004 Eastern League Champion New Hampshire Fisher Cats’ new stadium on the Manchester Riverfront is really taking shape as the team looks forward to its home opener against the New Britain Rock Cats on April 7. The state-of-the-art natural grass stadium, which will seat approximately 6,400 fans, was designed by HNTB out of Kansas City. This stadium is part of a major $100 million downtown development project which includes a hotel, luxury riverfront condominiums, and retail space. Architectural renderings and updated construction photographs, seating charts, sightlines, and images of the stadium’s 32 luxury suites can be viewed under the “New Ballpark” tab of the Fisher Cats’ website www.nhfishercats.com.
The team is hosting a special “Suite Tasting” this Thursday, February 17 from 4-7pm on the 12th Floor of the Hampshire Plaza, 1000 Elm Street in Manchester. Attendees will get a special sneak peek at the new stadium and luxury suites, have an opportunity to sample the food, and have the opportunity to talk baseball with the Fisher Cats’ management team. The Fisher Cats’ management team, led by General Manager Shawn Smith, has previously won two of minor league baseball’s highest front office awards – the Larry McPhail Trophy for excellence in promotion, and Baseball America’s Bob Freitas Award for overall operational excellence. As such, the Fisher Cats’ arrival in downtown Manchester means big business for the team, their neighbors, and the City as a whole. With the new stadium operational, the ‘Cats 71-game home schedule is expected to inject more than half-a-million fans annually into the downtown area, which, in turn, is expected to spawn many new businesses to cater to this new clientele. Opportunities for business synergies and co-branding abound.
The ‘Cats continue to accept all manner of corporate sponsorships, including fixed signage, rotating outfield signage, print advertising, theme night, and corporate giveaway sponsorships, providing myriad opportunities for local businesses to co-brand and promote with the New Hampshire Fisher Cats.
