MARTIN - Amparing Bergen's right leg, the long one, ends at mid-calf but swings reflexively in the way a youngster would beat her heels against a chair leg when announcing big news.

Life seems to work overtime, inventing new ways to punish residents of places such as the Pine Ridge Indian Reservation. Bergen has lost her legs to diabetes. She lives with nine other people in a four-bedroom house on tribal land near Martin. It is small, worn and 33 years old. A dark bloom of mold covers a cinder block basement wall like a newly seeded green.

Las Vegas Homeowners Expand Building Defect Suit Against Del Webb

LAS VEGAS (AP) - More than 1,500 homes have been added to a lawsuit against the builder of one of southern Nevada's largest master-planned communities, making the case Nevada's largest-ever construction defect case. Sun City Summerlin homeowners and nine homeowners associations claim in the amended complaint filed April 27 in Clark County District Court that Del Webb Communities failed to install metal strips to protect homes against water damage.

Fla. Court Affirms Ruling Against Seller in Dispute Over Disclosures, Deposit

LAKELAND, Fla. — A Florida Appeals court on March 30 affirmed a lower court order in favor of a man who backed out of a sales agreement and sued for the return of his deposit when he learned a condominium unit had undisclosed water and mold problems. Postregna v. Tanner, No. 2D03-4592 (Fla. App., 2nd Dist.).

Judge Refuses to Dismiss Chubb Entities Pending Discovery on Proper Party Issues

MINEOLA, N.Y. — A New York judge has denied, for the time being, a motion to dismiss Chubb Corp. and other Chubb affiliates from a mold coverage lawsuit brought by homeowners insured by a Chubb subsidiary. Shaevitz v. Chubb Corp., No. 15180/04 (N.Y. Sup., Nassau Cty.). New York County Supreme Court Justice Thomas Feinman said the Chubb entities could renew their motion for partial summary judgment after completion of discovery.
