NY Mom Says Mold Caused Baby's Injury, Not Abuse
by amny.com – September 19, 2008
SYRACUSE, N.Y.— A Syracuse woman who claims she was wrongfully convicted of assaulting her infant daughter when mold was actually to blame for the injury is getting a new trial.
Brandi Everson Gallishaw, who was accused of trying to smother her 7-week-old daughter, was convicted in 2001 of assault and child endangering charges.
The now 24-year-old Gallishaw served her 30-day jail sentence, but a state Supreme Court justice overturned the conviction earlier this year after the defense provided evidence to support Gallishaw's claim that she had laundered her baby's clothing in the mold-infested basement at her mother's home.
Lawyer Philip Rothschild says Gallishaw is eager to have the case tried again to clear her name. The trial is scheduled for next February. http://www.amny.com/news/local/wire/newyork/ny-bc-ny--mold-assaultcase0919sep19,0,538246.story ###
