E. Llwyd Ecclestone III and hiswife,
Patricia, who sold the home to the Paxsons. Also named in the Palm Beach County Circuit Court lawsuit is the builder,
Ecclestone Signature Homes Co.
The Paxsons claim the Ecclestones built and sold them a lousy house, one with defects in its walls, windows and doors that let water seep inside. They discovered the defects after last year's hurricanes, when the home became "inundated with water," Paxson lawyer
Robert Geisler said.An investigation revealed mold growing in interior spaces — mold that had been there for years prior to the storms, Geisler said.
The irony here is that for the past year, Devon has waged a bitter fight with his dad, Bud, to hang onto this very home. (Bud Paxson is chairman of West Palm Beach-based
Paxson Communications Corp., parent of the
PAX TV network.)
In 2000, Bud and Devon Paxson paid $2.3 million for the 8,694-square-foot home. But a money dispute led Bud to try to evict his son, daughter-in-law and grandchildren from the house in December 2003. They worked things out, though, and last December Bud and wife
Marla signed their share of the home over to Devon and his wife.
With their dream home now a mildewy nightmare, the younger Paxsons say health problems have forced them to live elsewhere. Geisler said his clients want the Ecclestones to pay for the home's cleanup, which could top $100,000.
