Protecting Your Association From Mechanics' Liens

A mechanic's lien is a security interest in the title to property for the benefit of those who have supplied labor or materials that improve the property. The lien exists for both real property and personal property.  In recent months, we have seen an increase in the filing of mechanics liens against associations.  Usually it the result of the association not paying a contractor - rather, the association has paid the contractor but the contractor fails to pay the subcontractor that performed the work.  Here are some steps your association can take to protect itself.
