Beware of Dogs! Requests for Comfort Animals Could Bite Homeowners Associations

What Exactly Does SB 89 Say & How Do We Comply?
Join us on July 25, 2006 from 6:00 to 9:00 p.m at our Arvada office (5610 Ward Rd., Ste. 300, Arvada, CO 80002) to learn about what changes the recently enacted SB 89 brought to the law and what actions your association will need to take to comply with them. Find out which of SB 100’s requirements have been changed and what new requirements have been added. Some of the topics we’ll discuss include list:
  • When an association must use a secret ballot
  • When an association must have an audit or review and who is qualified to conduct one
  • What a board member with a conflict of interest may or may not do under current law
  • What changes must be made to an association’s required policies & procedures to comply with SB 89’s amendments and what changes are recommended to take advantage of SB 89’s modifications of existing law

Recent Case: Application Of Payments
What happens when a delinquent owner starts paying monthly assessments again, but fails to pay off the delinquent balance? May the association apply these payments to the oldest outstanding debt or must the association apply these payments to the current monthly assessment so no further late fees will be incurred? This article discusses a recent case in which a trial court considered this question and the reasons for why it held the way it did.
