URGENT CALL TO ACTION RE: SB 100
At about 9:00 a.m. tomorrow, March 31, the full Colorado House of Representatives will hear and vote on the version of SB 100 recently passed by the Local Government committee of the State House. Many minor amendments to the bill were made, which can be found beginning on page 772 of the House Journal for March 28 located here (when the calendar appears on your screen, click on the March 28 date and then scroll to page 772).
This call to action is our urgent request and recommendation to you to call or email your State Representative tonight or to call to speak with their aide tomorrow morning (before 9:00 a.m.) to urge their opposition to one amendment expected to be proposed tomorrow and to urge their support for two amendments to be proposed tomorrow.
The first amendment expected, and which we urge and recommend your opposition, would limit or reduce the limited lien priority of owner associations (the so called "super lien") allowed under current law. We have not seen this amendment, but understand it will be introduced. Ask your State Representative to "Vote against any amendment that reduces the limited lien priority of associations."
The second amendment to be proposed, which we support, would correct a problem created in the House committee's recent amendments. The House committee approved the bill with new limitations on the ability of owner associations to recover their attorney fees in enforcing their governing documents. To remedy that amendment, tomorrow morning a second new amendment is to be presented to keep the full authority of current law, to allow associations to recover attorney fees. Ask your State Representative to "Vote for the amendment the preserves existing law on attorney fee responsibility for enforcement of the covenants and rules."
The third amendment is to be presented by Rep. Cheri Jahn (D-Jefferson County) and would require associations to offer annual owner education regarding the rights and responsibilities of owners. We support that amendment and urge you to support it as well. Please contact your State Representative with your support. Ask your State Representative to "Vote for the Jahn amendment."
