Homeowners Do Have A Right To Know...
We have received numerous emails asking for Orten & Hindman’s position on the recently introduced “homeowner rights” bill, Senate Bill 100.  This bill, sponsored by Sen. Bob Hagedorn (D-Aurora), is an attempt to give homeowners more rights within their respective associations.  Although we disagree with many of the provisions that the bill contains, we do agree that action must be taken to deal with the issue of increased conflict between homeowner associations and their owners.  However, SB 100, in its current form, is not the answer.

Update on SB 100
Committee Hearing Will Be Held On February 9, 2005
SB 100 will have its first hearing before the State, Veterans and Military Affairs Committee on Wednesday, February 9 at 1:30 pm on the 3rd floor in the Capitol. The hearing is open to the public and anyone interested can attend and testify.

HUD Proposes Mandatory Escrow of Community Association Assessments for FHA-Insured Mortgages
CAI Lends Proposed Rule Conditional Support
The Department of Housing and Urban Development (“HUD”) recently proposed an amendment to the federal regulation governing the single family mortgage insurance program of the Federal Housing Administration (“FHA”) that would “require mortgagees of FHA-insured mortgages…to collect as part of the monthly mortgage payment an escrow of the amounts necessary for the payment of these fees when they become due.”
