Case of the Month-Association's Decision Not to Submit Insurance Claim Upheld in Arbitration
Orten & Hindman recently represented a homeowners association in an arbitration that resulted in a victory for the association. The dispute arose out of the association’s decision not to submit a claim to the association’s insurer.

O&H Changes Foreclosure Fees
You spoke, we listened…In response to a recent survey of our clients, effective December 23, 2004, all new judicial foreclosure cases are handled on a fixed fee basis. Many clients expressed concern that judicial foreclosure of an assessment lien wasn’t always a viable option because of the cost, which can sometimes be as high as $15,000 even without a trial. With the continued growth in delinquent accounts judicial foreclosures should be a tool that association’s use. O&H is now handling all new judicial foreclosure cases for a fixed fee of $2850 plus costs.
