Accelerate Your Collections
When a community owner doesn’t make his monthly assessment payment, he harms the entire community. Every association relies on its owners to make monthly payments so that it can pay for the services and amenities its owners expect. One strategy you can use to cut delinquencies is adopting an “acceleration” policy. It works like this: If an owner hasn’t paid his assessment – typically, for at least 90 days – the association has the right to declare all of that fiscal year’s monthly assessments due immediately. Although some may consider this a tough measure, its effectiveness is undisputed.

New Auditing Standards Affect HOA Audits
Many homeowners associations hire an independent certified public accountant (CPA) to conduct an annual audit of the association’s financial statements. The procedures CPAs perform during an audit have changed dramatically as a result of many highly publicized accounting scandals and audit failures nationwide in the past few years. Although the types of fraud seen in those well-known cases typically do not occur in homeowners associations, the changes in auditing procedures apply to audits of all businesses, large and small.

Laws With Teeth
Associations frequently encounter conduct by individuals which approaches or crosses the line into criminal conduct. Unfortunately, due to crowded criminal dockets, limited public resources and the priorities of the criminal justice system, such conduct is not frequently the subject of criminal prosecutions. Recently the Douglas County District Attorney took action in one aggravated situation. The individual had been involved in an extended dispute with a homeowners association over operation of a commercial enterprise from a home, as well as minor landscaping and sign issues.
