BORROWING TO MAKE REPAIRS AND IMPROVEMENTS
As the association industry matures, more and more communities are faced with the responsibility and need to perform major repairs of common facilities. Often, because of poor planning, inflation or unanticipated problems, associations have not accumulated sufficient reserves to finance the needed repairs.
Typically, in the past, when faced with a situation where major repairs were required and funds were not available, associations had no alternative but to pass a special assessment to raise needed cash, defer repairs or complete the work piecemail over time. Each of these solutions has its own shortcomings and can create new problems for the board and the association members.
Fortunately, banks are becoming increasingly aware of associations' need for loans. Some financial institutions have even established specialized divisions to handle association needs. Loans can be a practical alternative to the choices listed above.

LEASING RESTRICTIONS
For a variety of reasons, associations, particularly condominium and townhome associations, frequently ask if they can restrict leasing in their communities. Concerns about financing and insurance often generate interest in leasing restrictions. Intangible costs may include perceptions that tenants do not have the same interest in the community and are more likely to violate rules and regulations; perceptions of difficulty in blending investor owners and tenants in the life and operations of the community; perceptions of a lack of interest by investor owners in common area maintenance and reserves if investor owners are in the community for the short term.

MINUTES OF ASSOCIATION MEETINGS AND BOARD MEETINGS
All actions by the Association's members and the board of directors should be evidenced by resolutions adopted by the members or the board of directors. The resolutions should be contained in the minutes of actual meetings, or in written consents, with voting of each participant indicated, in lieu of actual meetings.
