CCIOA Amendments
House Bill 02-1191 (It's No April Fool's Joke)

The 2002 Legislative Session concluded on May 8th with an amendment to the Colorado Common Interest Ownership Act (CCIOA) passed by the Legislature and referred to the Governor. While this one bill is now before the Governor, rumors continue to circulate about another amendment to CCIOA based on an April Fool's article in our April 1st newsletter. Based on that spoof, some have thought that covenant violations might become a felony. That is not the case. Yet, as of the writing of this article, amendments to CCIOA, through House Bill 02-1191, are before the Governor for his action. The Governor is expected to sign the bill. The bill is then expected to be effective late summer or early fall of 2002. This article discusses the provisions in House Bill 02-1191.

Water Restrictions

Fines and Violation Hearings
Fines can be an effective tool for enforcement of covenants and rules. However, it is necessary for associations to follow specified procedures prior to imposing fines. If these procedures are not followed, it is possible that the fines may be held invalid by a court.

Association-Sponsored Raffles
Many associations sponsor raffles as a means for raising funds or improving member turnout at meetings. What many communities are not aware of however, is that the Colorado Bingo and Raffle Law (as contained in C.R.S. §12-9-101 et seq.) regulates organization-sponsored raffles, and failure to comply with the raffle law is a class 2 misdemeanor. (This is not an April Fool's Day Joke!) Any organization holding a raffle for the purpose of commercial advertisement, creation of goodwill, promotion of new products or collection of names, where the raffle tickets are given away free of charge and without obligation on the part of the person receiving it, is exempt from the requirements of the raffle law.

Covering Increasing Insurance Costs
Homeowner association insurance premiums and deductibles are increasing drastically across the country. Associations should properly communicate these increases to owners to insure adequate coverage and avoid coverage gaps. All owners who live within condominium and townhome communities should have an HO-6 or Form 6 Homeowners policy. In addition to the owners' personal property, loss of use and personal liability, this type of policy generally offers some dwelling coverage.
