Time Running Out for Compliance with SB 89 ADR Requirement
SB 89 was signed into law on May 26, 2006. This new law addresses many of the amendments to the Colorado Common Interest Ownership Act (CCIOA) made by SB 100, which required clarification due to ambiguous or conflicting language, had unintended consequences, or did not mesh with the way that associations actually operate. To comply with the new law, associations are required to adopt an alternative dispute resolution (ADR) policy by January 1, 2007, addressing the association’s procedure for handling disputes between owners and the association. In addition, several required or recommended policies under SB 100 must be amended.  Click here.
