Top 10 Misunderstandings By Delinquent Homeowners
We asked our attorney and collection paralegals for the top misunderstandings deliquent owners have regarding the payment of assessments. Their answers may or may not surprise you.
  1. If I don't live in the house, I don't have to pay assessments.


  2. If I don't get a bill for assessments, I don't have to pay.


  3. The Association isn't doing its job, so I don't have to pay.


  4. I thought the HOA dues were coming out of my monthly mortgage payments.


  5. I paid for them at closing.


  6. My house is in foreclosure so I am not responsible any longer for any assessments.


  7. We agreed in the divorce that he/she would pay the assessments. 


  8. I filed bankruptcy.  I never have to pay assessments again.


  9. You didn't warn me you were going to garnish my bank account before you did it, so the funds are exempt from garnishment.


  10. I pay my mortgage on time, you can't foreclose on my house for failure to pay assessments
