Microb Phase Hearing Date Not Solid

Prosecutors leveling charges against Microb Phase Laboratories President Ronald Schongar, whose company sprayed a mystery agent in schools across the country as part of a mold remediation program, will state their case at a show cause hearing tentatively scheduled for Aug. 4.

Schongar, 58, of Clifton Park, N.Y., was charged with mail fraud, wire fraud and violations of the Federal Fungecide Insecticide and Rodenticide Act.

Assistant U.S. Attorney Brian E. Spears, who is prosecuting the case, said Tuesday that the hearing date is still tentative, but could not comment on the case itself.

Barring any changes, the hearing will take place before U.S. Magistrate Judge Joan G. Margolis at the federal courthouse in New Haven at 1 p.m.

Assistant U.S. Public Defender Terry Ward is defending Schongar, who has denied any wrongdoing.
Environmental Protection Agency investigators, led by agents Leonard Borges and Michael Hubbard, and the Easton Police Department are accusing Schongar of defrauding schools in Easton, Manchester and Bristol - though his company was hired by other schools in Connecticut, the Carolinas, Virginia, New Jersey and New York.

Schongar, who is a convicted felon, has been accused of forging referral letters, educational degrees, and material safety data sheets which list the ingredients of the agent used to combat mold. Investigators say they still do not know exactly what the company Microb Phase - which goes by eight different names - sprayed in the schools.
