Whilst the year ahead is marked with a great deal of uncertainty for businesses in Europe and around the world, what seems certain is that it is shaping up to be one of the most challenging years in living memory.  For some, the economic circumstances will produce great opportunities.  For many international businesses, however, there will be an increase in the likelihood of disputes, and an increase in the litigation risks they face.

Mediation in German Court Proceedings

Since 2005, we have in Germany the possibility to enter into mediation in pending court proceedings. This is a new possibility offered by some–not all–regional courts (Landgerichte) in Germany.

In Germany, regional courts (Landgerichte), generally speaking, have jurisdiction in all matters in which the amount in dispute is above EUR 5,000.00.

In connection with a research study carried out by a German University, some German regional courts (Landgerichte) have decided to offer parties in pending disputes the possibility to resolve the dispute in a court mediation.

Limiting Occupiers’ Liability: The Return of Common Sense

On the 7th of June 2006 Mrs Hunt, a forty-seven year old lady, paid a visit to Ripon in North Yorkshire to see the famed cathedral. Having looked round the inside of the building, her partner suggested that she might like to inspect the crypt. The crypt is located in the centre of the building. It is regarded by those who know the Cathedral as something of a jewel, since it is the oldest crypt in the country, having started life as the church built by St Wilfrid in 672 AD. It is reached by a set of wooden steps that lead to a narrow passageway and a final flight of four ancient sandstone steps. While descending the penultimate stone step Mrs Hunt had the misfortune to step on an area of depression in the sandstone. This caused her to fall and injure her ankle.
