Superamerica sues Minnesota Town over tobacco penalty, license suspension

BURNSVILLE, Minn. -- SuperAmerica is suing the City of Burnsville, Minn., for suspending in February the tobacco license of one of its stores there for selling cigarettes to minors, according to a report by the Associated Press. The Enon, Ohio-based convenience store and retail gasoline chain claims that the $10,000 fine and one-year suspension of the store’s license to sell tobacco was excessive, arbitrary and unconstitutional. The company argues in its complaint, filed in federal court last Thursday, that the penalties violate the constitution's ban on excessive fines.

"When we go into litigation, we're pretty limited on what we can say or do," oil company spokesperson Linda Casey told CSP Daily News. "But we're very hopeful [that we can beat the penalty]. We think it’s excessive."
