Court Facility Transfers 
AB 1491 (Jones) – Request for Comment
 
CSAC and Administrative Office of the Courts (AOC) continue to work with Assembly Member Dave Jones and Assembly staff to define the specific content for AB 1491, the court facility reauthorization measure. As noted in previous Bulletins, the following key elements have emerged as the framework for the bill.
 
1.      Extend the court facility transfer deadline to 12/31/2009.
 
2.      Establish “tiers” to incentivize expeditious transfers, as follows:
 
Before 9/30/08
County Facility Payment (CFP) is calculated pursuant to provisions of SB 1732 (2002) – “standard” CFP
10/1/08 to 3/31/09 (Tier 1)
Standard CFP + inflationary “price” factor (~2 to 3%)
4/1/09 to 12/31/09 (Tier 2)
Standard CFP + State Appropriations Limit (SAL, ~5%)
On or after 1/1/10
No further transfer agreements could be executed
 
We are pursuing a means to address a key county concern regarding the tolling of penalties when the delay in transfer is the result of an entity or circumstance outside of the county’s control. As soon as we have statutory language to share, we will distribute it broadly to counties. Assembly Member Jones intends to move AB 1491 on an expedited basis and as an urgency measure.
