This presentation will cover the top issues confronting dealerships today, including the Employee Free Choice Act ("EFCA"), recent amendments to the Family and Medical Leave Act ("FMLA"), and common wage and hour and pay plan issues. As to the EFCA, the presentation will address the history of the proposed legislation and the impact of the current proposal on dealerships. With respect to the FMLA, the presentation will discuss the expansion of the statute to cover military-related leave. Wage and hours issues to be addressed include time keeping requirements and mistakes. And the pay plan discussion will address both wage and hour, as well as contractual, aspects of pay plans.

By attending this presentation, you will understand the impact of EFCA, increase your knowledge of compliance with changes to the FMLA, recognize and be able to correct common time keeping errors and will ultimately take away how to protect your dealership with better pay plans.

Top Risk Management Tips to Protect Your Dealership

This presentation will highlight time-tested internal controls which have proven to be effective to mitigate, manage and minimize risk in connection with consumer transactions.
This presentation will cover recent law in connection with spot deliveries and deceptive advertising under the Florida Unfair and Deceptive Trade Practice Act (“FDUPTA”) including the attorney fee shifting provisions contained therein. Florida law regarding vicarious liability relating to ownership of motor vehicles will be covered as well as regulatory requirements for compliance with requirements for sending Adverse Action Notices, compliance with Gramm Leach Bliley (“GLBA”) and the FTC Guidelines for Protecting Consumer Information.

In addition, Florida procedural law will be discussed relative to the handling of legal process. From an insurance perspective, the role of the agent, the significance and meaning of binding coverage and receipt of binders from insurance agents and insurance agent liability will be covered.

By attending this presentation, you will increase your ability to identify risks at your dealership and take proactive measures to enhance training and develop protocols to avoid needless exposure to your store.
