CRITICAL VENDORS BEWARE
A PREFERENCE LAWSUIT MAY BE AROUND THE CORNER

According to a recent decision from the United States Bankruptcy Court for the District of Delaware, creditors the debtor identifies as “critical vendors” and who receive postpetition payments on account of their prepetition claims may still be subject to a lawsuit seeking recovery of payments made to the creditor prepetition as a preferential transfer.
